Saving the Offspring is considered one of the
purposes of the legislation. The provisions of this law are
intended to preserve it and not to attack it. The creation of
a strong offspring Which is far from the diseases that
damage or weaken it, is necessity or urgent necessity.
Hence our research highlights the estrange of marriage by
revealing the views of Foqhaa and their evidences and
revealing the medical point of view in order to reach a
clear view to adopt. This subject was dealt with a preface,
an introductory clarifying the concepts and terms of
research as the first request, and a second request to
clarify the views of the scholars; their evidence and their
discussion, and a third request for a statement of the
opinion of medicine on the theme. Then comes the
conclusion that shows the results and recommendations
and the most important of which was the absence of valid
legal texts for inference, which makes the ruling revolve
around desirableness and unpleasantness. The medical
opinion responds to the existence of genetic diseases in
the history of the family, so the study recommends
expanding the medical tests before marriage.
